Dog Attack at Chaparral Park

UPDATE #1 – First the dog trainer called me.

The below is a note from the dog trainer that Bella’s House & Pet Sitting works with. Our relationship with Mark has allowed us to help spread the word to many pet owners to help get this very troublesome story out. Please share and cross post with all….

As I mentioned to you today, one of my customers dogs, was attacked by 2 pitbulls last night in Chaparral Park off of Hayden, in Scottsdale.  The pitbulls were OFF leash and have a prior history of dog/dog attacks at this SAME park!  Unfortunately, AZ state law does NOT require a dog to be quarantined after attacking another dog.  ONLY if that dog bites a human, must it be quarantined.

A police report was filed and the case # is:  1012309.  I’m unsure if the dogs were even obtained and returned to the owners so they are STILL AROUND THE PARK!!  My customer will be contacting Maricopa Animal Control today to file a report as well.

Sadly enough, my customer has a $6000.00 vet bill from this attack and still does not know if her dog will survive today.   While the pits who attacked her dog could be BACK at the owners home with NO responsibility?

The concern of course now is for LOCAL SCOTTSDALE residents to BE AWARE of these 2 pits who will more than likely ATTACK again.  Please let your media contacts know of this pit attack pattern at Chaparral park.

NOTE: One lady at the park warned my customer “Get outa the park. The same dogs are who attacked last week are here.”  Before she could react – the fight happened.


Here is what my client wrote me: (warning it is graphic and hard to read)

As we walked around the lake a woman approached us carrying her dog and suggested that we not continue because there were 2 pitbulls loose, owner not present, a little way away. I could see them off in the distance.  She said she knew the owner and that one of the dogs has killed a dog before.  So I turn around and we were headed north to return to my car.  The woman had the police on the phone and was reporting the dogs.  Next think I knew the dogs ran up behind us and grabbed Sydney.  One of the dogs held her down with a tight bite over her back.  A lot of people ran to our aid but we could not get the dog to release Syd.  A couple pulled up on Hayden next to the path and brought a crowbar.  Someone used it to get the dog to release Syd. I scooped her up and this wonderful couple pulled me into their car and whisked us off to emergency as I held her side to keep her insides in.  She had to be in so much pain but never made a peep.  They took xrays of her back and her spine looks good.  She is in surgery at the moment.  She has some really bad puncture wounds, so they are opening her up and exploring everything to be sure her insides are okay.  A police report has been filed and I’m also suppose to contact Animal Control tomorrow.  This is so horrible – she was doing so well on the walked today – she will never get over this.

UPDATED #2  2:30 Tuesday May 18th – Update from Syd’s Mom…..

From Sidney’s Mom to Mark, from Doggie Steps Dog Training

Thank you Mark.  This was a horrible tragedy to see happen to your beloved pet.
I just picked up a copy of the police report and it is a frightening account of last nights attack.  The owner lives in a townhouse that opens to Chaparral Park on the southern end of the lake.  He has “Vicious Dog” signs on his front door and rear gate. He was under court order from the July 2009 attack that nearly killed a dog in the park to keep “Dopey” on a leash and muzzled.  Dopey killed a poodle in December 2009 while on leash.  Unfortunately the poodle was not leashed and got too near Dopey and the muzzle came off.  And yet, the owner still left his front door open yesterday evening for Dopey to escape the house and attack Sydney . Sydney ’s estimated vet bill has now reached a little over $11,000.00.  Dopey got to go home and my dog is suffering at the vet and may not survive.  I cannot afford this expense but I have to try to give her a chance, and I feel pretty certain that Dopey’s owner will not be held accountable for it.  Animal Control and the Scottsdale Police Department have been wonderful and are working hard to right this wrong.  Because of Sydney ’s attack, Animal Control obtained a court date on May 25th to deal with Dopey; the court was unwilling to deal with the issue after the poodle’s death – if they had, Sydney would still be her   active, silly self today.   Thanks again Mark.  I’ll keep you posted on Sydney . – Pamela

She came into work and told us all the story. she is deeply concerned about Syd and was hoping to find out how the poor sweetie was doind, and we are all concerned as well.     Well we were just about to leave (keep in mind that we were LEAVING which is the cage on the right and the people coming IN is the cage on the left if you view it from inside the park). Well we were leaving and I see a man with a pitbull coming in. I hear it growling and snarling. As I get the leash on Tessa I heard that pit start to run and I … look over my left shoulder and saw it bolting for a dog that was about the same size as a Boston terrier. That pit had its target picked out before I got Tessa’s leash on. I know the dog latched on to its target and everyone started running towards the skirmish. Tessa and I were walking away so I’m not sure to what extent the other dog got hurt. But then as I was driving away I saw him walking down Hayden with his dog so I’m guessing the people there asked him to leave. That target could have easily been Tessa and we haven’t been back. Not sure if this is the same owner of the same pitbull that this article is about but this man looked homeless with a very long beard and clothes that had holes in them and he was very grungy. The pit was mostly brown and was overweight and was wearing a black harness. That’s all I remember. So sad to hear this story. Makes my heart break.

    OMG!!! I am so glad I found this!!! I am the woman who used the tire iron to pry Dopey’s jaws open. I called every hospital in the area last night to see how that little dog was doing and I got nowhere. I also called the police and got nowhere. I hope Sydney is going to be okay…I could not stop thinking about this last night. I just called and spoke to Bella about this. Would be great to try to raise some money to foot this vet bill.     I am very thankful for the other two men, I’m not sure what would have happened if they weren’t there. It is good to know that when push comes to shove there are individuals out there that will pull together when someone is in need.

    I know this sounds lame, but who is this Shandra lady, misleading on her info. the only individuals there were 3 men and Sydney’s owner, I was in the car. The men were the ones to get the dogs apart. I would hate to think someone is making a mockery of this situation.

    This is SO sad. I cannot imagine the pain of seeing your loving pet being hurt. I have two dogs that are part pit and they wouldn’t hurt a fly. It makes me so angry that a dog owner would want to turn these animals into vicious dogs that hurt others and frighten people. The owner should have to pay 100% of the vet bill and should be forced to try to at least rehab his dogs or turn them over to a rescue. These two dogs are the owners responsibility and he caused this horrific incident – he should pay.

    I was in the park shortly after the attack happened and the owner of the Pits took at least one of them back to his house. He is living right along the park by Chapparal road. I have seen him there on a regular basis walking the dogs, although I never saw them off leash. They are massive animals and they more or less are pulling the owner across the lawn. Seems these dogs are more in charge than the guy. My daughter now is afraid taking our dogs over there walking because of that. It is a sad story and I hope the insured dog will recover.

    I can assure you I was there with my friend. We were walking and happened upon the attack right after it started, I believe before the car pulled up. We (mostly the guys who were fishing) tried several times to kick the pit to get him to release Sydney. Then after someone’s suggestion, I dumped my water on the pit’s face to get him to let go which didn’t work. Finally, someone brought the tire iron and one of the guys there was going to use it beat the pit, but I grabbed it and used it to pry the pit’s jaws apart. At that point, the owner took Sydney to the car and one of the men held down the pit with his knee until the police arrived. It was pretty horrible and I can’t imagine anyone claiming to have been there who wasn’t.

Maybe aggressive or dogs with ANY prior history of violent attacks not be allowed at our dog parks? Anyone want to start a petition who was there?     Sydney is my beautiful, sweet, Border Collie and I want to thank everyone who helped me save her life yesterday. Words are not enough to tell you all how grateful I am for the selflessness of so many strangers! Thank you all! Sydney is stable for the moment. The surgeon had to remove her kidney and said that the muscles on her right side were so badley shredded that he is not sure if she will be able to stand or what kind of nuerological damage she may have. They found bone fragments from her spine and there may be a break. He doesn’t know yet if there is any spinal cord damage. She has a big incision up her pretty little tummy (that she loves to roll over and show you) and large incisions on both sides. There are drains sticking out both sides. Its day to day for now. The surgeon called me during surgery last night and asked if I wanted to put her down – I just could not make that decision so quickly, although I do not want her to suffer. He said that in all of his practice he has never seen a dog’s insides shredded so badly after a dog attack. The really sad thing is that Dopey attacked another dog last summer and killed a dog in December. The owner has big signs on his front door and rear gate stating “vicious dog” and yet left his front door open yesterday and let Dopey out. He obviously doesn’t get it and doesn’t care! I also want to share that the Scottsdale Police and Animal Control have been great! Hopefully they will find a satisfactory way to punish this owner! And I hope that he has to pay restitution to at least the tune of the $11,000 vet bill I am currently facing! Thank you again. I’ll try to keep you posted.

    I would love to help with a petition! My friend and I walk there twice a week, at least until it gets to be 115 degrees. Bella has my number. Please let me know if there is anything I can do. I would also love to help put together a fundraiser to pay the vet bill, if Dopey’s owner isn’t held accountable for it.

  • My heart goes out to Pamela and Sydney. What a nightmare! I am so sorry you and all involved, had to go through this. I hope Sydney gets through this.
    Dopeys owner better pay for the full vet bill. Keep us informed! Bella and I already talked about a fundraiser. I have done fundraisers in the past for rescues, so it would be my pleasure to do one to raise money for Sydneys vet bills if for some reason Dopeys owner doesnt pay.

    I petsit and walk dogs around the lake all the time and this just makes me so nervous. I really hope something is done to get the crazy dogs off the streets and to get the owner to be accountable for his actions, its not fair for people to be nervous any time they go to that lake to enjoy a walk! urg, stories like this make me so upset:(
    I just dont understand how someone with a vicious dog can be so careless. If a dog is labeled vicious by the courts(as i think these were since they had the viciosu dog sign on gate)there are VERY strict guidelines that the owners have to take to keep their dogs. Otherwise they are PTS. I am pretty sure that if you petition to the courts for another vicious dog report, they owner will never get his dog back again…..

It’s so unfortunate that there are not laws on the books for dog/dog bites or attacks.. only dog/human.     Just got my morning report from the vet. They have gotten Syd to eat a tiny little bit and they actually got her to walk outside, although with a lot of stumbling!! Woo Hoo!! Can’t wait to see her a little later! Thanks again for all of your love and prayers!

    I just came across this chat about a dog attack at Chapparel Park and have to say how horrified I am. My husband and I used to live near the park and walk our dog there. We took her to the doggy park and I guy brought in his pitbull. As soon as he took him off the leash he ran to our dog and bulldozed her and ripped a hole in her tummy. The guy rushed out with the dog. We never found him. We had to take our dog to the vet and had large vets bills. It took awhile to heal. It was horrible. This guy knew his dog was violent and took it to a dog park. Obviously trained to attack. A person can have a civil suit if they know who he is. But its a pain. If its in open park or public areas and the dog is not on a leash that is a violation. But who is there to help? Whats it going to take to before this guy goes to jail or has his dog removed? Public safety should be the top concern and he has proven he cant control his dog nor can he keep him secured. Its got to be the same guy!

    Oh my gosh – Sydney walked to me today. The Tech walked her down the hall and we had a wonderful visit in a little reception room instead of in ICU!! She just sat and didn’t seem too interested in the effort and pain of laying down, and it was very difficult for her to stand, but she’s walking!!! I took her favorite toy, a freesby with me – I thought seeing it would cheer her up, but she just looked up at me with those big brown sad eyes as if to say “mom, you’ve got to be kidding!” :) Still many hurdles to clear. The bone fragraments in her spine might become a problem. They would normally put her in a back brace, but can’t with all the other injuries. But she’s walking!!! I will cook her some nice ground beef for dinner tonight as we are trying to get her to eat and then we can get her on oral instead of the intravenous pain med. On another note, according to the Animal Control officer, Dopey’s owner seems willing to make restitution for Sydney’s costs so I will give him a call and see what we can work out. Hug your puppies!!

    That is super to hear about the willingless for Dopey’s dad to help with restitution. Although, I am really concerned about how WE as a COMMUNITY are going to make sure that Dopey can never do this again. There is a history of this behavior and I don’t feel confident that it won’t happen again. In addition – there needs to be MAJOR educational awarness (maybe that is where my platform comes in?) with EDUCATING all pet owners about training (www.doggiestepsdogtraining.com) and socializing their pets. THEN knowing that loving your pets doesn’t mean letting them do whatever they please. Pets are just like kids. You can’t let them run around town doing things becasue it is “fun.” That is how they get in trouble, to say the least.

    A couple of quick comments to Dog Lover and Danielle. Can you describe the dog that attacked your dog – and when was it? If there is any chance that it was Dopey and after the July 2009 attack (when Dopey was under court order to not be in public without a leash and muzzel) you still may have a chance for recovery. Sydney is at the VCA animal Emergency Hospital on Country Club south of McKellips in Mesa. This is absolutely the place to take any animal in an emergency particularly if your Vet is closed. They provide excellent 24-hour doctor and nursing care.

    Pamela,

    First of all, I would like to say…I am very happy to hear that your pup is doing better. I would make the owner pay current and future vet bills associated with this attack and if he doesn’t take him to court. I am sure any judge would see your side and you have plenty of witnesses to help plead your case. Sydney may or may not suffer mental trauma but I know if Sydney does it will be hard to get Syd to go outside. We have a dog that has been attacked twice and like your pup we were very lucky he did not pass. My, Border Collie/Pointer Mix, Toby, recently had his throat ripped open and the dog just grazed his jugular..the vet said if my husband hadn’t taken the next bite instead of Toby..Toby would of been instantly killed.

    Make this guy pay for his stupidity and the pain and suffering that your poor Syd has, is and will continue to suffer from his neglect. It is sad that this dog was trained to be so aggressive and others have to suffer for it. My thoughts and prayers go out to you and Sydney..Take care and when you are able give Syd a big hug…

My sister lives so close to the park and we go there all the time. We have to do something about this dog and dog owner and more importantly something about the law that does not protact our loved ones. I will help in any way I can.

    We (me and my dogs)want to send our love and prayers to you and Sydney. Allie is a Border Collie and I can really relate to her big brown eyes that tell you so much. I have a whole section in my scrapbook about Allie’s eyes! Thank God for the people in the park that were there and willing to risk personal injury to help you.

    I have very mixed emotions about Dopey and the owner. While I really appreciate the owner stepping up to his responsibility with Sydney, I am very angry that he didn’t take the responsibility of being a dog parent seriously. I’m a pretty firm believer that there are no bad dogs just bad owners. I’ve known alot of pit bulls that were wonderful animals but then again they had wonderful owners too. Not sure what the answer is in this situation,is rehabilitation for the dog and the owner even a possibility?

  • I have seen this at the dog park on Ray Road in Gilbert as well. I had a Pit Bull come in the gate and the owner said “I hope she doesnt attack another dog tonight” as she let the dog off the leash! Just as I heard that of course the dog picked my dog to attack! I refuse to go to dog parks there are just way too many irrisponsible dog owners out there! It is very sad. It could be any kind of dog, its the owners who are letting this happen!

    According to the ICU nurse, Sydney is now “trotting” around outside. The account I received this evening is that they were trying to figure out last night how to get Sydney up and walking and while they were trying to figure out a plan, someone decided that Syd needed to be weighed. When they went to pick Syney up, she apparently decided that she was having no more coddling and stood up and walked around ICU to be weighed on her own terms (did I mention how determined she is…?). She is doing amazingly well and surprising all of her doctors and nurses. I took her some hamburger tonight and she dived into it until I had to remove the remainder to prevent her from getting sick (she normally cares very little about food) The greatest news is that she may get to come home on Friday! I sat with her for a very long time tonight. She stretched out in her ICU kennel and seemed at peace – it broke my heart to leave her for the night :( I could only leave knowing that she will soon be home, curled up in bed beside me for a peaceful night’s sleep after many sleepless nights.

    A friend of mine just sent me a copy of the blog regarding the pit bull attack at Chapparell Park. I was horrified to hear of this as I have lived in this neighborhood for over 30 years and have walked all of my dogs in that park. My heart goes out to you Pamela and I cannot begin to imagine what you have been going thru. I am sure like me, your dog is considered “one of your kids”. I am so happy to hear that she is doing so well and possibly will be going home on Friday. I sure hope that something is done to this man and his dogs for all of the trouble he has caused over the past few years. I have forwarded a copy of the blog to several of my friends who also take their dogs to Chapparell Park and I am sure, like me, they will not be going there for a while. I am definately not a fan of the Pit Bulls and I don’t think that they should be allowed in homes as they are very vicious dogs and I hope that they do put these 2 down. After reading the blog I caught the 6 pm news and they had another story from California about another pit bull that attacked a little girl. She was able to get into her house but the dog followed her and the mother got a gun and shot it which just goes to show you again how vicious these dogs are. I certainly hope we don’t have to walk our dogs in the park with a gun to keep us safe. Again my prayers are with you and you dog and I hope she is with you again very soon.

    walking. I am the one that ran into Pamela at the park while I was running away carrying my dog & words cannot even describe how traumatic the entire experience was. Pamela, I have been thinking of you & Sydney since the attack and my prayers are with you both. If there is anything that I can do to help in any way please let me know. Please know that I have filed a grievance with the hoa & I am attending a meeting & requesting his immediate eviction. The owner is negligent & has no respect for public safety & I refuse to allow him & his dog run amuck in our neighborhood anymore. I will fight to make sure incidents like this don’t happen again. If action had been taken after the 1st attack we would not be here today. Again, I am so sorry that this happened to you & I am praying for a speedy recovery for Sydney.

    Wishing Sydney a speedy recovery! What a special dog! It’s not just Chaparral Park. For whatever reason, dog parks have become a haven for aggressive pit pulls in the past few years. My Australian Shepherd has been attacked at dog parks on 63rs Ave north of GCC and at the Rose Mofford Park.

    Just so everyone knows, I found out that the pit bull Dopey was allowed to return home. Apparently, Scottsdale does not require that dogs that have attacked other dogs be put down or taken away. It is up to the discretion of the dog owner, and he has decided to bring his dog back. I live 2 doors down from him, so I am very fearful of taking my dog Farley out on a walk. I am going to be contacting the city to see if we can pass an ordinance that requires aggressive dogs to either be out down after an unprovoked offense, or require that aggresive dogs live outside of a 1 mile radius of public parks. If anyone knows more information as to the current rights of dog owners, please let me know. I will also be making a suggestion to my HOA to add a dog breed by-law.

    I have not stopped thinking about your sweet dog and the horror you went through. I hope Sydney recovers quickly! I was forwarded this email and I have taken my dog to that dog park many times.

  • Syds owner can file a vicious dog complaint via the court system.
    I forget if its through Pd or just going down to court to get paperwork started. The dog will be impounded til court date and then after verdict,
    given back to owner with strict rules(some have teeth removed, have to move, etc, or put to death.
    I hate breed restrictions, there should be owner restrictions.
    I want to get a petition for people that want to own pitbulls and other
    High prey drive to have to pass a test, take a class and enroll in ongoing traingclasses for them and dog!

  • Rescue Mom:

    Mandated breed restrictions are not the answer to INDIVIDUAL dog issues like the one illustrated here. I used to go to dog parks with my large dogs. I never had a single issue with a bully breed. I DID have issues with German Shepherds, Chows, Labs, Huskies, Malamutes, Golden Retrievers, and even Chihuahuas. My point is that ANY breed can behave in dog-aggressive ways. Blame the idiot owner who is not being a responsible dog owner, NOT the breed of dog.

    Also, don’t mistake dog aggression with human aggression. Those are two totally different issues, with two totally different training/prevention approaches. Ask any behaviorist.

    I would suggest that a dog park user registration/user fee might help weed out some of the clueless owners who wander in off the street with their dogs.

    My suggestion: All victims get together and sue the pants off of Dopey’s owner. Go to http://www.azbar.org to find an attorney if you don’t already know one. There are attorneys who specialize in animal law. Although he may not be legally obligated to turn the dog over to police or put the dog down, he is definitely responsible for your damages (vet bills, training to get over the trauma, etc.). If/when he can’t afford to pay the amounts that he clearly owes you, offer to reduce the amount due in exchange for him taking responsible action regarding his dog(s).

    New Update: I spoke with the HOA Board last night, and they said that unless the owner of the townhome that he is renting from requests him or the dog to leave then their hands are tied. Unfortunately, she is refusing to evict him and/or Dopey, and to make matters worse, rumor is that he has been granted a lease extension! The only way to get the dog out of the area is if a lawsuit and court order is pending. I have heard that because of all the media that Animal Control will come back and take Dopey away until the May 25th court date. I suggest that anyone who can goes to the meeting. Also, I know that Jared has said that he will pay for all the vet bills. I spoke with my neighbor whose dog he killed in December, and she said the same was promised to her. $6000 later, he has not paid a penny. It looks like the only way to truly get anything from him will be to file a lawsuit. Also, I would think about filing a grievance with the homeowner since she has had the authority to do something about this on 2 previous ocassions…I believe she can be legally liable. Please keep us posted on Sydney’s recovery, and I will make sure to keep everyone informed on this end.

    Sydney’s home!!! :) And snoozing happily and comfortably next to me. They pulled the drains out this morning, so the openings are continuing to drain….all over my floor…. Therefore, we are confined to my “tiled” family room and I had to cover the area rug with towels. We’ll just be couch potatoes all weekend and watch movies. Because of the small pieces of fractured bone near her spine, she is not allowed to run or play for 6 to 8 weeks to avoid putting any strain on her back. Try to tell a 3-year old Border Collie that she can’t run and play and has to stay quiet…! This is going to be a tough 6 to 8 weeks! :- Even with as bad as she’s feeling, her first trip outside had to include an attempt to herd my 2 desert tortoises. Guess I’ll have to take her out on leash from now on. It’s been a very long week and we both are pretty tired so perhaps a nap is in order for me as well. Thanks again to everyone for all of your kindness, support and prayers – you all have done Sydney and me a lot of good!! :)

    FYI – Jared did cover the bill at the emergency hospital and has agreed to cover the follow up Vet bills.

    I have been following your story since I first heard about it. My 7 month old Westie was attacked my a Pit several years ago and survived. We were lucky. I am so glad Sydney is home with you. I also have an Austr. Shep/Border Collie mix so I can only imagine the difficulty you are having keeping her calm and inactive. Thank you for keeping all of us informed. As you can tell, there are so many people watching out for the two of you. God Bless.

    We’re nearing the end of the weekend and it has been a long one. Sydney is healing but getting her to eat and stay quiet has been quite the challenge! I have had to put up most of her toys to keep her from trying to play with them. She has never been a “chow hound”, but doesn’t seem interested in eating much of anything right now. I have tried, various canned food, hamburger, chicken, cottage cheese, scrambled egg & cheese (normally her favorite). I’ve resorted to pushing all of her meds down her throat because cream cheese, hotdogs and peanut butter no longer work. If all goes well, all the staples should come out on Friday and then we can begin to get back to normal. I have loved having a little snuggle puppy curled up next to me all weekend – normally, she doesn’t slow down enough for me to get this kind of attention :)
